Except to the extent where required by law, no portion of the balance of this card is refundable or redeemable for cash.

The Quilt Shack is not responsible for any unauthorized use of this card. You agree to defend and indemnify The Quilt Shack from and against any claims, expenses or liabilities made against or incurred by any of them in connection with your use of the gift cards or in violation of these terms and conditions.

The Quilt Shack reserves the right to deactivate or reject any gift card issued or procured, directly or indirectly, in connection with fraudulent actions, unless prohibited by law.

This card is not reloadable.

Lost or stolen gift cards can only be replaced upon presentation of the original sales receipt for any remaining balance. It will be void if the original sales receipt is altered or defaced. The Quilt Shack will have no liability to you for lost or stolen gift cards or the use by a third party of your gift card.

THE QUILT SHACK MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, WILL BE THE REPLACEMENT OF THAT GIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

The Quilt Shack does not permit the resale of its gift cards without its prior written consent. Gift cards may be used as personal or business gifts, but may not be used in connection with any marketing, advertising, or other promotional activities (including without limitation via web sites, internet advertisements, email, telemarketing, direct mail, newspaper and magazine advertisements, and radio and television broadcasts) unless you obtain our prior written approval.

From time to time, you may be awarded with or receive “rewards,” “promotional gift cards”, “credits”, “vouchers”, “Groupons” or similar physical or electronic gift cards (collectively, “Promotional Cards”). As a general matter, these promotional cards shall have the same terms and conditions as the gift cards described here, however, they may be subject to additional restrictions or exemptions as provided on the promotional cards themselves or any packaging or other written materials that accompany such promotional cards or any applicable law.

The laws of the State of Oregon, without regard to principles of conflict of laws, apply to these terms and conditions and your use of the gift card.

Any dispute relating in any way to the gift cards shall be adjudicated in any state or federal court in Crook County, Oregon, and you consent to exclusive jurisdiction and venue in such courts.

The Quilt Shack reserves the right to change the terms and conditions from time to time in their discretion, which changes we may provide to you by any reasonable means, including without limitation, by posting the revised version of the terms and conditions at thequiltshack.com/termsandconditions.
